Ann is a part-time Senior Special Projects Attorney with the ILRC in Davis and San Francisco, where she works on a variety of family-based matters. Deportation Defense
Many people are able to keep themselves from deportation through a variety of avenues. The first is obtaining asylum if they fear persecution in their home country. Another is obtaining withholding of removal or protection under the Convention Against Torture (CAT). Individuals may also qualify for this relief if they have physical, family, or community ties in the United States and can prove that their removal would cause extreme hardship to them or their families.
It is important to understand the difference between deportation and removal. The latter is the formal process of removing someone from the country and can be initiated through an NTA, removal orders or criminal convictions such as document fraud, drug offenses and domestic violence crimes.
Those who are in the midst of deportation or removal proceedings face severe consequences including separation from loved ones and potential loss of life or livelihood. To help these individuals, many communities and localities have started and expanded innovative public defense programs that provide federally funded representation for immigrants in deportation proceedings.
